Terms of Service

Welcome to YardKonnect! These Terms of Service ("Terms") govern your access to and use of YardKonnect's mobile application and web platform (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using YardKonnect, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must meet the following requirements to use YardKonnect:

• You must be at least 18 years old
• You must be legally capable of entering into binding contracts
• You must not be barred from using the Service under Nigerian law or any other applicable jurisdiction
• You must provide accurate and complete information during registration
• You must comply with all local, state, and federal laws applicable to your use of the Service

3. Account Registration and Security

Account Creation

To access certain features of YardKonnect, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Identity Verification

YardKonnect may require identity verification (including government-issued ID) to ensure the safety and security of all users. Failure to complete verification may limit your access to certain features, including property listings and rental applications.

4. User Roles and Responsibilities

Landlords

If you are a landlord or property manager, you agree to:

• Provide accurate and truthful property information and photos
• Honor rental agreements and lease terms
• Respond promptly to tenant inquiries and maintenance requests
• Comply with all applicable housing laws and regulations
• Not discriminate against tenants based on protected characteristics
• Maintain your properties in a safe and habitable condition

Tenants

If you are a tenant, you agree to:

• Provide accurate information in rental applications
• Pay rent on time as agreed in your lease
• Maintain the property in good condition
• Report maintenance issues promptly
• Comply with lease terms and property rules
• Not engage in illegal activities on the property

5. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post false, misleading, or fraudulent property listings or applications
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Transmit viruses, malware, or other malicious code
• Scrape, crawl, or use bots to access the Service
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to compete with YardKonnect
• Collect personal information from other users without consent

6. Payments and Fees

Rent Payments

All rent payments are processed through our payment partner, Paystack. By making a payment, you agree to:

• Paystack's terms of service and privacy policy
• Pay all applicable fees, including payment processing fees
• Provide accurate payment information
• Not dispute legitimate charges

Service Fees

YardKonnect is currently free to use. We reserve the right to introduce fees for certain features in the future. We will provide advance notice of any new fees. Continued use of the Service after fee implementation constitutes acceptance of the new pricing.

7. Property Listings and Content

Content Ownership

You retain ownership of any content you post on YardKonnect (property listings, photos, descriptions). However, by posting content, you grant YardKonnect a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and promoting the Service.

Content Standards

All content you post must:

• Be accurate and not misleading
• Not infringe on any third-party rights
• Not contain offensive, discriminatory, or illegal content
• Comply with all applicable laws and regulations
• Not contain spam or advertising for other services

8. Limitation of Liability

YardKonnect is a platform that connects landlords and tenants. We do not:

• Own, manage, or control any properties listed on the Service
• Guarantee the accuracy of property listings or user information
• Act as an agent, broker, or representative for landlords or tenants
• Guarantee that properties meet your expectations or requirements
• Guarantee payment, rental agreements, or lease enforcement

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARDKONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Disputes Between Users

You are solely responsible for your interactions with other users. YardKonnect is not responsible for resolving disputes between landlords and tenants. However, we may provide tools and support to help facilitate communication. In case of serious disputes, we recommend seeking legal advice or using appropriate dispute resolution mechanisms.

10. Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• You abuse or harass other users
• We are required to do so by law
• We discontinue the Service

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will cease immediately.

11. Intellectual Property

The Service, including its design, features, text, graphics, logos, and software, is owned by YardKonnect and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our prior written consent.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. We may also notify you via email or push notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Abuja, Nigeria.
